This paper develops a critical reflection on the doctor duty to warn, presenting both as bioethical as legal foundations. Places the patient as a moral agent, active subject of doctor-patient relationship and provided with autonomous will. Moreover, seeks to presents some criteria that can help the health professional when to assess what risks the patient must have knowledge for taking a free and informed decision.
