Abstract

OLIVEIRA ROTONDANO, Ricardo; SOUZA, Naionara Maia  and  ALMEIDA ARMENTANO, Giovanna. Change of civil registry for transgender people without the need for sexual reassignment surgery in Brazil. Rev. Bioética y Derecho [online]. 2021, n.51, pp.261-282.  Epub Mar 29, 2021. ISSN 1886-5887.

This article conducts a study of the social landscape of oppression faced by transgender people in Brazilian society. The historical trajectory of prejudice and discrimination permeates not only the actions of society, but also of the Brazilian State. To overcome these social barriers, we analyse the decision handed down by the Federal Supreme Court in the Direct Action of Unconstitutionality 4.275/DF, which recognised the right to change the name and sex in public records of transgender people without the need for sexual reassignment surgery and judicial decision. Using bibliographic, documentary, comparative, historical and interview techniques, through qualitative research, using inductive and dialectical methods, the case study assesses the possible advances of the referred decision in the scenario of subordination of transgender people in Brazil.
