Abstract

SANTOS DIVINO, Sthéfano Bruno. Artificial Intelligence as a subject of law: construction and critical theorizing about personality and subjectivity. Rev. Bioética y Derecho [online]. 2021, n.52, pp.237-252.  Epub Oct 25, 2021. ISSN 1886-5887.  https://dx.doi.org/10.1344/rbd2021.52.31503.

This article aims to answer the question: can an artificial intelligence be considered a subject of law? There is a possibility of affirming the proposed problem by observing the subjectification process of this entity. The first process comprises the emancipation of being from the system of domination. The second process determines the interspecies recognition in society for commuting emancipation. Finally, the third process concerns subjectification and claim rights, which may take place in the face of an Artificial General Intelligence (AGI) claim. An integrated search method and literature review technique are used.

Keywords : Artificial intelligence; personality; subjectivation; subject of rights.
