Abstract

ATIENZA, Manuel. On Surrogacy. Another turn of phrase. Rev. Bioética y Derecho [online]. 2022, n.56, pp.107-124.  Epub July 17, 2023. ISSN 1886-5887.  https://dx.doi.org/10.1344/rbd2022.56.40721.

The author insists, with regard to a recent Spanish Supreme Court ruling, on three theses on surrogacy that he has already defended: it is not a practice prohibited in our law (nullity is not the same as illegality); it is not, in itself considered, against the human dignity of the pregnant woman or the child; and its regulation does not necessarily have to require the pregnant woman to do it for free, although the remuneration that she may receive should not be left to the laws of the market.

Keywords : surrogacy; nullity; illegality; prohibition; human dignity; free of charge.
