Material and Methods: We have reviewed books and articles published in the literature review and consultation documents cited in the bibliography. Abstract: The painful shoulder, considering under such term several processes with the same dysfunctional significance, is a common cause of prolonged medical incapacity processes, either in those reaching or extending 365 days of low (temporary incapacity), or in passing processes to a situation of permanent disability. By this type of process the assessment of temporary incapacity needs a careful evaluation like the one that we propose; considering also the importance of the medical devices evaluation. The painful shoulder is a cause of long-term occupational absenteeism. It is therefore necessary to implement measures that without decreasing the protection of occupational health contribute to the most prompt and complete recovery of the related functional limitations. Returning to work after painful shoulder disability should have an implicit preventive consideration, as well as the valuation of functional job capacity restitutions and their correlation with those required by work. Although such return to work is not always easy or free of discrepancies or controversies it must be provided. We propose some measures to make it possible without detriment to the worker´s health, or to make him to be unprotected. The determination of the labor contingency for a painful shoulder (either an occupational accident or a professional illness) is extremely common. Its consideration requires compliance with the established legal and medical causation requirements set forth.
