SANTOS-DIVINO, Sthéfano Bruno  e  GONCALVES-ALMEIDA, Isabela. Telemedicine, Ethics and Resolution n. 2.314/2022 of the Brazilian Federal Council of Medicine: Application parameters, subsidiarity, literacy and information security. Rev. Bioética y Derecho [online]. 2023, n.57, pp.115-132.  Epub 24-Jul-2023. ISSN 1886-5887.  https://dx.doi.org/10.1344/rbd2023.57.40797.

On May 5th, 2022, the Brazilian Federal Medicine Council defined and regulated Telemedicine through Resolution No. 2314/2022. Based on this theoretical framework, the following question is proposed as a research problem: is the Brazilian normative able to deal with the ethical issues of greatest incidence in telemedicine? The objective is to identify and define standards and principles which the physician should adopt during Telemedicine, emphasizing the patient-centered relationship. Subsequently, Resolution 2.314/2022 of the Brazilian Federal Medical Council is critically detailed from the point of view of three precepts. As a result, there is a lack of regulation for the use of technologies for medical purposes, which reflects ethical challenges. We conclude that the deficient regulation of telehealth causes legal and bioethical problems, converging values and principles that presuppose constancy and integration in the doctor-patient relationship. The method used is integrated research through a bibliographic research technique.
