In our medical center were answered in 2012, first 1,304 assists, 85 of which were considered non-occupational accident/occupational disease. We have chosen randomly 10 clinical cases where there was disagreement by the patient when the medical services determined that the disease suffered by the patient was no accident and / or aggravated by what has led to his primary care physician who issued from low for common contingencies and contingencies determining the INSS was initiated by the Andalusian Health Service. In 7 cases there was discrepancy between the GPs INSS inspectors and medical services mutual in 3 of them were considered to be common illness pre-existing disease. Of the cases analyzed we found that there was no unified, clear and precise criteria between pre-existing illness, aggravation and / or work accident depending on the evaluating physician and / or medical mutual determine whether it was accident. If there were no medical history by SAS and / or previous low for ITCC for the same or a similar disease INSS always determined contingency as accident. The average time of the 10 cases analyzed between the start of the determination of contingencies and communicating the resolution by the INSS was 240 days. Of the 7 cases were work-related accident, 6 still on sick leave and one case was cured and incorporated into their job.
